The High Speed 2 railway scheme is the largest transport scheme in the Northwest since the M6.

The scheme is split in two sections: Phase 2A (Birmingham to Crewe) and Phase 2B (Crewe to Manchester). Some works South of Crewe have commenced already however north of Crewe the railway will not be functional until 2035-2040.

HS2 is a Hybrid Act of Parliament, therefore the Act is a mixture of private and public bill characteristics. Ultimately once the Act obtains Royal Assent, HS2 has the Compulsory Purchase Powers to acquire rights and property on a temporary and permanent basis. Having worked on Phase 2A for landowners and occupiers south of Crewe, we understand the process of the Hybrid Bill, Petitioning and ultimately how it works on the ground when HS2 take possession of the land or property. As a land agent it is quite common that we deliver the bad news, of extra land being taken or a scheme taking longer. There is no point when effected by a scheme of this magnitude by burying your head in the sand or not engaging. Those landowners/ occupiers who did not petition are in affect agreeing to what’s in the plans. At Selby Rural we ensure clients are aware of the process and how difficult this roller coaster is going to be from start to finish and the numerous drainage issues there will no doubt be following completion. Those people impacted by HS2 should not be any worse or better off but be “in effect” in the same position as if it was not happening (which is easier said than done). That is why it is so important that we do the right thing for our clients.

The amount of compensation you may be entitled to from HS2 depends on the location of your property to the scheme, the type of property and your right to claim compensation.

HS2 has a few compensation schemes available to landowners and occupiers. However for those claimants affected by the scheme receiving Notices to Treat or General Vesting Declarations to acquire permanent rights of acquisition, you should in effect be receiving the ‘market value’ of what you are losing i.e. what would that property or interest sell for on the date of notice or entry as if the scheme was not happening, this is referred to as the un- blighted value. There are additional payments on top of this such as homeowners/ occupiers’ loss, legal fees, time and inconvenience.

The length of time it takes to receive compensation from HS2 depends on the type of compensation scheme that you are claiming under. It is possible to submit an advanced claim once in receipt of a notice to acquire permanent rights, however the issue then comes on agreeing values with HS2 and then the HS2 sign off process to receive funds is incredibly slow.

The speed of the new railway is not the main reason for HS2. The main reason for the high- speed rail link is to reduce the number of foot passengers off the West Coast mainline and for this to be utilised by more freight services and thus reducing the amount of lorries and HGVs on the road networks.
